Please read these Terms and Conditions ("Terms") carefully before using the printer support services offered by Sun World Printing ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Service Agreement
These Terms constitute a legally binding agreement between Sun World Printing, located at 17 Candy Ln, Gorham, NH, 03581-4835, United States, and you, the user of our printer support services.
1.1 Acceptance of Terms
By engaging our services, scheduling a service appointment, purchasing a service plan, or using our remote technical support, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional guidelines or rules applicable to specific services.
1.2 Modification of Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
2. Service Description
Sun World Printing provides technical support, troubleshooting, maintenance, and repair services for various printer models and brands.
2.1 Remote Technical Support
Our remote technical support services include telephone and online assistance for printer configuration, software troubleshooting, driver updates, and resolution of common printer issues. By using our remote support services, you authorize our technicians to access your computer systems as necessary to diagnose and resolve printer-related issues.
2.2 On-Site Services
On-site services include physical inspection, repair, and maintenance of printer hardware at your location. Service availability may vary based on your geographic location and the nature of the required service.
2.3 Service Plans
We offer various service plans, including pay-per-incident support, monthly maintenance plans, and annual service contracts. The specific terms, coverage, and limitations of each plan will be provided at the time of purchase and form part of these Terms.
3. Service Appointments and Scheduling
For on-site services, appointments must be scheduled in advance. We will make reasonable efforts to accommodate your preferred appointment times, subject to technician availability.
3.1 Cancellations and Rescheduling
If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance by calling (603) 466-2818 or emailing lucilleponce@sunwprintsupp.com. Late cancellations or missed appointments may result in a cancellation fee equal to 25% of the scheduled service cost.
3.2 Service Delays
While we strive to meet all scheduled appointments, unforeseen circumstances may occasionally cause delays. We will make reasonable efforts to notify you of any delays and reschedule at your convenience.
4. Pricing and Payment
Service rates and fees will be disclosed prior to service delivery. For emergency or after-hours services, additional charges may apply.
4.1 Payment Terms
Payment is due upon completion of service for one-time services. For service plans, payment terms will be specified in your service agreement. We accept major credit cards, checks, and electronic payments.
4.2 Late Payments
Overdue payments may accrue interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower. You will be responsible for all reasonable expenses incurred in collecting overdue payments, including legal fees.
5. Parts and Warranty
All replacement parts used in repairs are either new or refurbished to meet manufacturer specifications.
5.1 Parts Warranty
Replacement parts are warranted against defects in materials and workmanship for 90 days from the date of service or for the remainder of your service plan term, whichever is longer.
5.2 Labor Warranty
Labor for repairs is warranted for 30 days from the date of service. This warranty covers only the specific issue addressed during the original service and does not cover new problems or issues unrelated to the original repair.
5.3 Warranty Exclusions
Warranties do not cover damage resulting from accidents, misuse, unauthorized modifications, improper maintenance, use of non-compatible supplies, or normal wear and tear. Consumable items such as ink, toner, and ribbons are not covered by any warranty.
6. Customer Responsibilities
To ensure effective service delivery, you agree to:
- Provide accurate information about your printer issues and system configuration
- Ensure reasonable access to printers and related equipment
- Maintain a safe working environment for our technicians
- Back up all data before service is performed
- Have an authorized representative (18 years or older) present during on-site service
7. Data and Privacy
During service delivery, our technicians may have access to your computer systems and data. We respect your privacy and will access only information necessary to provide the requested services.
7.1 Data Security
We implement reasonable security measures to protect any data we access during service delivery. However, no data transmission or storage system can be guaranteed to be 100% secure. For more information on how we handle your data, please refer to our Privacy Policy at Privacy Policy.
7.2 Data Backup
You are solely responsible for backing up your data before service is performed. We are not responsible for data loss that may occur during service delivery.
8. Limitation of Liability
To the maximum extent permitted by law, Sun World Printing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, resulting from or in connection with these Terms or the use or inability to use our services, regardless of the cause of action.
8.1 Maximum Liability
In no event shall our aggregate liability for any claims arising out of or related to these Terms exceed the total amount paid by you for the specific service giving rise to the claim in the 12 months preceding the event giving rise to the liability.
8.2 Essential Purpose
The limitations of liability in these Terms will apply even if any limited remedy specified fails of its essential purpose.
9. Indemnification
You agree to indemnify, defend, and hold harmless Sun World Printing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your violation of these Terms or your use of our services.
10. Term and Termination
These Terms remain in effect until terminated by either party. We reserve the right to terminate or suspend service to you at any time for violation of these Terms or for any other reason we deem appropriate.
10.1 Effect of Termination
Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions.
11.1 Dispute Resolution
Any dispute arising from or relating to these Terms or our services shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in accordance with the rules of the American Arbitration Association before resorting to arbitration or litigation.
11.2 Arbitration
If mediation is unsuccessful, any controversy or claim arising out of or relating to these Terms or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall take place in Coos County, New Hampshire, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
12. General Provisions
12.1 Entire Agreement
These Terms constitute the entire agreement between you and Sun World Printing regarding the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Sun World Printing regarding the services.
12.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
12.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Sun World Printing.
12.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.
